This Waiver is entered into between your photography or 3D-tour business and the client signing on-site, and covers all services performed at the specified property — including Matterport scanning, iGUIDE capture, traditional photography, and drone operations. The client confirms they have read the document and had the opportunity to seek legal counsel.
The client explicitly acknowledges the inherent hazards of a live shoot environment:
In exchange for the services rendered, the client releases your business from **all liability, claims, and causes of action** arising from personal injury, property damage, or disruption to smart-home systems — except in cases of gross negligence or willful misconduct. The release extends to the client's heirs, assigns, and legal representatives.
If the client owns or manages the property, they agree to **indemnify and defend** your business against third-party claims tied to undisclosed property hazards, the actions of others present during the session, or unauthorized access allegations. The client also warrants they hold legal authority to grant access and sign on behalf of all stakeholders.
Clients may not handle or move your equipment without express consent. If they or their guests cause damage, they're liable up to the specified cap. For drone sessions, the client takes responsibility for keeping the operating zone clear of people and obstructions during flight.
Your total exposure is capped at the **session fee actually paid** — protecting you from runaway consequential or punitive damage claims while keeping the agreement fair and enforceable.
