What is the Refund Policy?

The Refund Policy is a photographer-friendly contract template that establishes clear rules governing when refunds are and are not owed for real estate imaging services. It covers delivered digital deliverables, pro-rata partial refunds for undelivered scope attributable to the photographer, dispute resolution through non-binding mediation, credit memos as settlement alternatives, and chargeback handling — giving real estate photographers, 3D tour creators, and aerial imaging professionals a legally structured document to set client expectations before a shoot.

When should you use this form?

The Refund Policy should be used any time a real estate photographer, Matterport or 3D tour operator, or aerial imaging professional accepts payment for digital deliverables. It is especially important before onboarding new agents or brokerages, when offering packages that include multiple deliverable types (stills, video, floor plans, virtual staging), or after experiencing a chargeback or refund dispute that revealed gaps in existing client agreements.

What this form covers

No-Refund Rule for Delivered Work

All sales are final once digital deliverables — still photographs, 3D tour links, aerial footage, edited video walkthroughs, floor plans, and virtual staging composites — have been delivered via your chosen delivery method.

"Delivered" means the Photographer has transmitted download links, shared gallery credentials, published a 3D tour hosting URL, or otherwise made finished media available to the Client — regardless of whether the Client has viewed, downloaded, or used the files.

Dissatisfaction with subjective aesthetic choices (e.g., editing style, composition, color grading) that fall within industry-standard practice does **not** constitute grounds for a refund.

Partial Refunds for Undelivered Scope

A partial refund may be issued **solely** when the Photographer fails to deliver a discrete, identifiable portion of the agreed scope and that failure is attributable exclusively to the Photographer — not to access issues, Client cancellation, listing agent delay, or circumstances beyond the Photographer's reasonable control.

Eligible partial-refund amounts are calculated on a **pro-rata basis** against the total contract value. Partial refunds are not available for:

  • Minor omissions corrected within the agreed revision turnaround window - Scope reductions requested by the Client after the shoot has commenced - Delays caused by property access restrictions, inclement weather, or third-party platform outages

Dispute Resolution Process

If a refund request cannot be resolved through good-faith written correspondence, both parties agree to submit the dispute to **non-binding mediation** before a mutually agreed-upon mediator in the governing state — before pursuing any other legal remedy. Mediation costs are shared equally.

Credit Toward Future Services

As an alternative to a cash refund, the Photographer may offer a **credit memo** equal to the disputed amount, applicable toward future services booked within the specified validity window. Credits are non-transferable and carry no cash value. Acceptance of a credit constitutes full and final settlement of the underlying claim.
