The Drone Liability Waiver is a property-owner-facing release agreement used by FAA Part 107-certified drone operators and real estate photographers before conducting aerial UAV operations at a private property. It documents the property owner's acknowledgment of inherent flight risks, releases the operator from certain damage claims, establishes indemnification for third-party and neighboring-property incidents, and discloses the operator's commercial drone liability insurance coverage.

What this form covers

1. Parties and Scope

This Drone Liability Waiver is entered into as of the scheduled flight date by and between your drone operation business (the "Operator"), holding FAA Part 107 certification, and the undersigned property owner or authorized representative ("Property Owner"). It applies to all UAV operations at the specified Property address.

3. Acknowledgment of Inherent Risks

Property Owner expressly acknowledges risks including:

  • **Adverse weather** — wind gusts, precipitation, rapid visibility changes - **Mechanical/electronic failure** — batteries, motors, or control systems - **RF or GPS interference** — signal loss between pilot and aircraft - **Physical obstructions** — power lines, branches, or structures not visible from the ground - **Wildlife and third-party interference** during active flight operations

4. Release of Claims — Property Damage

Subject to the **gross negligence exception**, Property Owner releases the Operator and all Released Parties from claims for damage to landscaping, roofing, gutters, exterior fixtures, vehicles, fencing, pools, and outbuildings occurring during flight operations.

This release **does not** apply where damage results from the Operator's conscious and voluntary disregard of reasonable care standards.

5. Indemnification — Third-Party and Neighboring Property Claims

Property Owner agrees to indemnify and defend the Operator against claims brought by owners, occupants, or guests of **neighboring properties** arising from the Property Owner's authorization of drone operations, any condition of the Property that contributed to an incident, or any action/inaction by the Property Owner during flight ops.

6. Insurance Coverage Disclosure

Operator discloses commercial drone liability insurance at a stated per-occurrence limit. Property Owner is advised to verify whether their existing homeowner's or landlord's policy covers incidents from licensed drone operations conducted on-site.

7. No-Fly Zone and Airspace Acknowledgments

Property Owner warrants the Property is not in restricted airspace without authorization, confirms no local ordinances or HOA rules prohibit drone operations, and affirms they hold legal authority to grant airspace access above the Property for commercial aerial photography.
