The Extended Commercial License is a written agreement between a real estate photographer or visual-media business (Licensor) and a client or brand (Licensee) that supersedes any prior standard MLS or single-listing license. It grants clearly scoped rights to use licensed media across out-of-home advertising, paid digital and broadcast campaigns, brand collateral, and national or regional marketing campaigns. Fees are structured across three reach-based tiers tied to campaign impression thresholds, and prominent-placement rules govern billboard and large-format OOH use.

When should you use this form?

Use the Extended Commercial License when a client intends to repurpose real estate photography or 3D tour media beyond a standard MLS listing — for example, in a billboard campaign, a paid social or display ad, a developer's investor deck, a trade-show backdrop, or a regional or national brand rollout. It is also appropriate when a previously licensed image is being moved into a higher-reach campaign that exceeds the impression threshold of an existing agreement.

  • **Tier 1 (Local/Regional):** Up to 500,000 impressions - **Tier 2 (Multi-State):** 500,001 – 5,000,000 impressions - **Tier 3 (National/International):** Over 5,000,000 impressions

Clients select the appropriate tier at signing and agree to upgrade — and pay the difference — if their campaign grows beyond the chosen threshold.

Prominent-Placement Rules

For billboard and large-format OOH placements, the agreement requires **advance written notice** before installation, including location, dimensions, and run dates. A mandatory attribution credit line ("© [Photographer Name] — All Rights Reserved") is required wherever custom crediting is standard practice. Any substantive alteration — AI-generated extension, compositing, architectural removal — requires prior written approval.
