The Non-Exclusive License is appropriate when a photographer wants to sell usage rights to real estate images or 3D tours to more than one agent, broker, developer, or portal without surrendering copyright. Use it when listing photos are delivered to multiple MLS participants, when the same aerial footage is licensed to both a listing agent and a developer, or when a photographer intends to retain portfolio and resale rights over the work after delivery.

This agreement is entered into between the photographer ("Licensor") and the client ("Licensee") in connection with Licensed Content produced for a specific property. The Licensor retains full copyright ownership and expressly reserves the right to license the same images, 3D tours, and aerial footage to **multiple parties simultaneously** — a defining feature of the non-exclusive model.
The license is limited strictly to the property address named in the agreement and to uses the photographer specifies in plain language — for example:

Photographers set both a **duration** (e.g., 12 months, 2 years, or perpetual) and a **geographic scope** (e.g., United States, worldwide). When the term expires, the licensee must immediately stop using the content and destroy or return all copies.

Licensees receive no veto power over how the photographer markets their own work.
Licensees **cannot** sublicense, sell, or transfer their rights without written consent. A narrow carve-out allows sharing with the licensee's own employees and contractors — but only for the permitted uses, and only under equivalent restrictions.
A one-time license fee is due by a set date, delivered within a specified number of business days after payment clears. Overdue invoices accrue interest automatically after a configurable grace period.
