The Filming Recording Consent is a video-specific release form designed for real estate photographers, Matterport and iGUIDE tour providers, and drone operators. It captures irrevocable consent from on-camera participants, bystanders, and audio subjects for perpetual, multi-media use of their likeness, voice, and image in property marketing, listings, social media, portfolio display, and commercial advertising. A separate minor-participant provision requires a parent or guardian co-signature when the participant is under 18.
The Filming Recording Consent should be used before any real estate photography or video session where a person's face, voice, or identifiable likeness may appear in the final deliverable — including walkthrough videos, Matterport 3D tours, iGUIDE scans, drone footage, or listing photos featuring homeowners, tenants, agents, or staged models. It is also appropriate when a bystander is incidentally captured in wide-angle or aerial footage at or near the property.

Participant irrevocably consents to being filmed, video-recorded, and/or photographed while appearing on camera in connection with the described session. Their likeness, image, voice, name (if stated on camera), and performance may be incorporated into the final deliverable(s).
Filmmaker and Filmmaker's clients, licensees, and authorized distributors receive the right to use, reproduce, edit, adapt, publish, publicly display, broadcast, stream, and otherwise exploit the recordings **in perpetuity throughout the universe in all media now known or hereafter devised** — covering real estate marketing, property listings, social media, portfolio display, and commercial advertising.
Participant expressly consents to the recording of their voice, spoken words, ambient sound, and any other audio captured during the session. Audio tracks may be synchronized with visual footage, edited, mixed with music or sound effects, or otherwise modified as part of the final production.
If a Participant appears **incidentally in the background** of footage taken at the session location — rather than as a principal subject — they nonetheless consent to such incidental appearance and grant the same rights described above. Filmmaker will make reasonable efforts to minimize identifiable close-ups of bystanders without written consent; however, incidental background appearances in wide-angle, aerial, or walkthrough footage are unavoidable and are covered by this Agreement.
The rights granted include rights under applicable right-of-publicity statutes and common-law doctrines. Participant waives any right to inspect or approve the final edited footage or advertising copy — and no use of their likeness shall imply an endorsement unless a separate paid endorsement agreement has been executed.
If Participant is under 18, a parent or legal guardian must co-sign, confirming legal authority to grant all consents on the minor's behalf.
