What is the Minor Model Release Guardian Consent?

The Minor Model Release Guardian Consent is a parent- or legal-guardian-signed release form granting photographers, 3D virtual tour creators, and reality-capture professionals limited, non-exclusive rights to use a minor's image and likeness in property-related media. It defines permitted and prohibited uses, establishes a guardian review-and-approval window before publication, and automatically expires on the minor's 18th birthday, at which point a new adult-signed release is required.

When should you use this form?

Use the Minor Model Release Guardian Consent whenever a person under 18 appears—or is likely to appear—in still photos, Matterport or iGUIDE 3D tours, drone footage, floor-plan visuals, or any promotional materials captured during a real estate or property shoot. It is especially relevant for occupied family homes, school or community facility shoots, and any session where a guardian is present on-site and able to sign before the session begins.

What's included in this template?

  • Parties and relationship section identifying photographer, business, guardian, and minor
  • Grant of rights covering still photos, 3D tours, drone footage, floor plans, and interactive media
  • Permitted uses tied to a specific property address
  • Hard-coded prohibited uses: alcohol, tobacco, cannabis, adult content, political advertising, and unapproved endorsements
  • Guardian review-and-approval period with configurable calendar-day window before publication
  • Right of withdrawal clause with configurable compliance deadline for the photographer
  • Automatic expiration of all rights on the minor's 18th birthday
  • Indemnification, governing law, dispute resolution, and severability clauses
  • Signature blocks for photographer and guardian with date fields

What this form covers

Parties and Relationship

This agreement is executed by **[PHOTOGRAPHER LEGAL NAME]**, operating under **[PHOTOGRAPHY BUSINESS NAME]**, and **[GUARDIAN LEGAL NAME]**, acting as the lawful parent or legal guardian of **[MINOR FULL NAME]** (date of birth: **[MINOR DATE OF BIRTH]**). By signing, guardian confirms they hold full legal authority to grant image and likeness rights on the minor's behalf.

---

Grant of Rights

The license covers still photography, 3D virtual tours (Matterport, iGUIDE, etc.), drone and aerial footage, floor plans, interactive media, and promotional materials created for the property at **[PROPERTY ADDRESS]**. Rights are non-exclusive and royalty-free within the scope defined below.

---

Restricted and Prohibited Uses

This release contains **hard-coded prohibitions** — no legal drafting required:

  • ❌ Alcohol, tobacco, e-cigarettes, cannabis, or controlled substances - ❌ Adult or sexually suggestive content (anything above PG-13) - ❌ Political advertising or advocacy of any kind - ❌ Unapproved brand or product endorsements - ❌ Defamatory, demeaning, or misleading portrayals

Violations entitle the guardian to **immediate revocation** of all granted rights.

---

Review and Approval Rights

Before any public or commercial publication, photographer must share materials with guardian, who has **[REVIEW PERIOD DAYS]** calendar days to raise a written objection. Publication is blocked while any timely objection remains unresolved.

---

Expiration on Age of Majority

All rights granted automatically **expire on the minor's 18th birthday**. Continued use after that date requires a fresh, independently signed release from the subject as an adult — a key protection built directly into the template.

---

Right of Withdrawal

Guardian may withdraw consent at any time before the minor turns 18. Written notice is sent to **[PHOTOGRAPHER EMAIL]**, and photographer must cease all new uses within **[WITHDRAWAL COMPLIANCE DAYS]** days of receipt.
