The Model / Talent Release is a commercial release agreement for real estate photographers, 3D tour creators, and proptech professionals when identifiable people appear in delivered media. It grants a worldwide, perpetual, royalty-free license covering name, image, likeness, voice, and performance across all media formats, and includes explicit marketing-likeness authorization for portfolio, advertising, and platform-demo uses beyond the immediate property listing.

When should you use this form?

The Model / Talent Release is appropriate any time an identifiable person appears in real estate photography, video walkthroughs, 3D Matterport or iGUIDE tours, or related media intended for listing platforms, MLS systems, paid advertising, or photographer portfolio use. This Release is entered into between the Photographer (or their business) and the named Talent, tied to a specific shoot date and property address. If the talent is a minor, a parent or legal guardian countersigns — keeping you legally covered for every scenario.

Grant of Rights

Talent grants a **worldwide, perpetual, royalty-free license** to use their name, image, likeness, voice, and performance across all current and future media formats — including property listing platforms, MLS systems, social media, digital advertising, broadcast, streaming, out-of-home advertising, and trade publications.

This is purpose-built for real estate media: a staged occupant walking through a kitchen, an agent presenting a living room, or a model standing in an architectural space — all covered in a single signature.

Marketing-Likeness Authorization

Unlike a simple bystander release, this form includes **explicit marketing-likeness authorization**, covering:

  • Photographer portfolio and showreel uses - Client case studies and platform demos (Matterport, iGUIDE, and similar proptech tools) - Trade show, conference, and educational presentations - Paid advertising campaigns in any medium

Rights Holders are not required to seek fresh approval before each individual use — eliminating the friction of follow-up permissions months after the shoot.

Compensation

A one-time talent fee is specified with a clear payment-due window (in business days after the shoot). If the engagement is fee-free, the form acknowledges in-kind or professional-exposure consideration so the contract remains enforceable.

Waiver of Claims and Indemnification

Talent waives inspection and approval rights and all publicity / privacy claims within the grant's scope. A **mutual indemnification clause** protects the photographer from Talent's warranty breaches, and protects Talent from uses that exceed the Release's scope.
