What is the Realsee 360 Capture Agreement?

The Realsee 360 Capture Agreement is a client-facing service agreement designed for real estate photographers and 3D tour providers who shoot and publish virtual tours using the Realsee platform. It establishes the scope of a single capture session, defines hosting terms under Realsee's third-party cloud infrastructure, grants embed and MLS syndication rights, and governs the full tour lifecycle — from shoot day through renewal, handoff, or archival. Optional add-ons such as hotspot annotations and floor tags are also addressed.

When should you use this form?

Use the Realsee 360 Capture Agreement before any paid shoot where the deliverable is a Realsee-hosted virtual tour. It is especially appropriate when a listing agent or broker expects to embed the tour on a property website, submit the shareable URL to an MLS board, or syndicate the link to portals such as Zillow or Realtor.com. It is also the right document when clients need a defined hosting term with clear renewal, transfer, or archival options at expiration.

What's included in this template?

  • Acceptance and scope clause for a single Realsee 360° capture session
  • Fee schedule, payment terms, and optional add-on pricing structure
  • Realsee third-party hosting disclosure with defined initial hosting term and renewal notice
  • Embed rights and usage license for the shareable link and embed code
  • MLS syndication permissions for Zillow, Realtor.com, Homes.com, and affiliated portals
  • Tour lifecycle options: renewal, tour handoff with transfer fee, or archival after 7-day grace period
  • Hotspot and floor-tag configuration caps with client content-accuracy obligations
  • Shoot-day responsibilities, cancellation and rescheduling policy, limitation of liability, indemnification, confidentiality, and governing law

What this form covers

Acceptance and Scope

This agreement is entered into between your photography business and the client as of the agreement date. It covers a single Realsee 360° capture session for the specified property, including panoramic processing, tour publication to your Realsee account, and delivery of the shareable link and embed code within your stated turnaround window. Optional add-ons — hotspot annotations, floor tags, custom branding — require a signed written addendum.

Realsee Hosting and Server Terms

The published tour is hosted on Realsee's cloud servers under the Service Provider's account. The agreement clearly acknowledges that Realsee Co., Ltd. is a third-party platform and that uptime, data-retention, and platform policies are outside the photographer's control. The **Initial Hosting Term** is defined in months, with a built-in 14-day renewal notice sent to the client's email before expiration.

MLS Syndication Permissions

Clients receive explicit written permission to submit the Realsee shareable URL to their MLS board and affiliated portals such as Zillow, Realtor.com, and Homes.com — strictly for marketing the listed property. The clause makes clear that MLS rules compliance is the client's responsibility, and that static exports for portals that don't support interactive links are available as an add-on.

Tour Lifecycle, Renewal, and Handoff

At expiry, clients choose from three clearly defined paths:

  • **Renewal** — pay a set fee to extend hosting for another period - **Tour Handoff** — pay a one-time transfer fee and take ownership in their own Realsee account - **Archival** — if no election is made within 7 days, the tour may be archived with no liability to the provider

Realsee Feature Configuration: Hotspots and Floor Tags

The agreement specifies exactly how many hotspots and floor tags are included at no extra charge, caps the included count, and establishes that clients supply lawful, accurate content for all annotations — protecting you if a client submits misleading or unlicensed copy.
