What is the Recurring Volume Agent Contract?

The Recurring Volume Agent Contract is a standing bulk-pricing agreement between a real estate photographer and a single agent that governs every listing shoot placed during the contract term. It establishes monthly minimum shoot commitments, three-tiered per-listing rates, shortfall fee protections, priority scheduling privileges, and a right of first refusal on new listings. The template covers photographs, aerial/drone imaging, 3D virtual tours (Matterport, iGUIDE, etc.), floor plans, and related media under a single invoicing cycle.

When should you use this form?

The Recurring Volume Agent Contract is appropriate when a real estate photographer has an agent who books consistently — typically two or more listings per month — and both parties want to lock in predictable pricing and scheduling terms for an extended period. It suits photographers offering 3D tours, drone imaging, or bundled media packages who need shortfall-fee protection during slow months and want to prevent the agent from quietly routing shoots to a competitor.

What's included in this template?

  • Monthly minimum commitment with shortfall-fee and rack-rate reversion clause
  • Three-tier volume pricing structure (photos only, photos + 3D/drone, full premium bundle)
  • Add-on services note (twilight, virtual staging, rush delivery) excluded from volume discounts
  • Priority scheduling terms with complimentary same-week rush booking allowance
  • Right of first refusal notice window before agent may hire another photographer
  • Deliverables and delivery timeline specifications per shoot type
  • Termination clause with 30-day written notice and pipeline-completion terms
  • Intellectual property licensing, independent contractor status, and limitation of liability provisions

What this form covers

Acceptance and Scope

This Agreement is entered into between your photography business and a single real estate agent, establishing a standing relationship that governs every listing shoot placed during the contract term. It covers photographs, aerial/drone imaging, 3D virtual tours (Matterport, iGUIDE, etc.), floor plans, and related media — all under one roof, one contract, one invoicing cycle.

Monthly Minimum Commitment

Agent commits to a set number of listing shoots per calendar month. Hit the minimum and every shoot is billed at the agreed volume rates. Miss it, and a per-listing shortfall fee kicks in — protecting your revenue even in a slow month for the agent.

> *"In any calendar month in which Agent fails to meet the Monthly Minimum, Photographer reserves the right to invoice Agent for a shortfall fee … or to revert that month's completed shoots to standard rack-rate pricing, whichever is greater."*

Three-Tier Volume Pricing

  • **Tier 1 — Photos only** — your cleanest, lowest rate for straightforward listing shoots. - **Tier 2 — Photos + 3D tour or drone** — the bread-and-butter mid-tier most agents will land on. - **Tier 3 — Full premium bundle** — photos, 3D tour, drone, and floor plan all in one.

Add-ons like twilight shoots, virtual staging, and rush delivery are quoted separately and not subject to volume discounts unless agreed by written amendment.

Priority Scheduling & Right of First Refusal

Volume agents earn a shorter booking lead time than standard clients, plus a set number of complimentary same-week rush bookings per month. In return, the agent must give you a right-of-first-refusal notice window before hiring any other photographer — keeping your pipeline full and your relationship exclusive in practice, if not in name.

Termination

Either party can walk away with 30 days' written notice. All confirmed shoots in the pipeline are completed at volume rates, and outstanding invoices are due per the normal payment terms. No surprises, no clawbacks.
