What is the Referral Agreement?

The Referral Agreement is a customizable contract template designed for real estate photographers, 3D tour creators, and proptech professionals who want to formalize compensation arrangements with referring partners. It defines the parties involved, establishes a flat-fee or percentage-based fee structure, sets a clear payment trigger, and governs the referral coverage period, exclusivity terms, submission process, and post-termination carve-outs in a single binding document.

When should you use this form?

The Referral Agreement is appropriate whenever a real estate photographer or visual-media business begins receiving client leads from a recurring source — such as a real estate agent, brokerage, fellow photographer, or proptech partner — and wants to formalize the compensation arrangement before the first referral is submitted. It is also the right document to use when converting an informal, handshake referral relationship into a written agreement with defined fee triggers and coverage periods.

What's included in this template?

  • Parties and scope identifying the Service Provider and Referring Party
  • Referral fee structure: flat fee or percentage of gross invoice
  • Payment trigger selection: booking confirmation, shoot completion, or full payment received
  • Referral coverage period for repeat or follow-on bookings within a defined window
  • Exclusivity clause with scope definition for exclusive arrangements
  • Referral submission and tracking requirements with acknowledgment timeline
  • Exclusions and dispute process for contested referral claims
  • Post-termination carve-out ensuring fees are paid on pre-termination bookings

How do I fill out this form?

  1. Open the form at forms.wgan.info. Navigate to the Referral Agreement template page on forms.wgan.info and click the button to begin filling out the online form in your browser — no account required.
  2. Enter party names and business details. Type the legal name of your photography or visual-media business as the Service Provider, then enter the Referring Party's name, business name, and contact information in the designated fields.
  3. Select fee structure and payment trigger. Choose either the flat-fee or percentage model, enter the specific dollar amount or percentage, then select one of the three payment trigger events that best matches your billing workflow.
  4. Define coverage period and exclusivity terms. Set the number of months a referred client remains covered for repeat bookings, then indicate whether the arrangement is exclusive or non-exclusive and specify any scope limitations.
  5. Set the agreement term and notice period. Enter the initial contract duration, the number of days required for written termination notice, and the payment window in calendar days for remitting referral fees.
  6. Download and distribute the completed agreement. Review all entries on the summary screen, then download the finished PDF. Share a copy with the Referring Party for signature and retain a copy for your own records.

What this form covers

Parties and Scope

This agreement is entered into between your photography or visual-media business (**Service Provider**) and a **Referring Party** — whether that's a real estate agent, brokerage, fellow photographer, or proptech service partner. It sets out exactly how referrals are submitted, tracked, and compensated.

---

Referral Fee Structure

Choose the model that fits your relationship:

  • **Flat fee** — a fixed dollar amount per referred client engagement, or - **Percentage** — a percentage of the gross invoice billed to the referred client

Only one structure applies, selected at signing. The default fallback is the flat fee if no option is initialed.

---

Payment Trigger

You control when the fee actually becomes payable. Pick from three clearly defined trigger events:

  • **Booking Confirmation** — the referred client signs a service agreement or pays a deposit - **Completion of Shoot** — you complete the on-site session - **Full Payment Received** — you receive the client's full invoice payment

Payment must then be made within the agreed number of calendar days via your chosen method (ACH, PayPal, check, etc.).

---

Referral Coverage Period

Every referred client is "covered" for a set number of months from their first booking. Any repeat or follow-on work booked within that window continues to generate a referral fee — protecting the Referring Party's long-term interest without requiring a new referral submission each time.

---

Exclusivity and Submission Process

Agree to an **exclusive** or **non-exclusive** arrangement, with scope clearly defined if exclusive. All referrals must be submitted in writing before first client contact, and you commit to acknowledging each submission within a set number of business days — keeping the process clean and dispute-free.

---

Term and Termination

The agreement runs for an initial term you define, with either party free to exit on written notice. A clean **post-termination carve-out** ensures fees are still paid for any client whose booking was confirmed before the termination date.
