What is the Residential Real Estate Photography Agreement?

The Residential Real Estate Photography Agreement is a contract template designed for solo photographers providing residential property photography services to homeowners or listing agents. It covers the full scope of a standard shoot engagement, including service scope, fees, payment terms, scheduling, image licensing, deliverable specifications, and cancellation rules. The photographer retains copyright throughout, while the client receives a limited, non-exclusive license for MLS and marketing use.

When should you use this form?

The Residential Real Estate Photography Agreement is appropriate any time a solo photographer is hired by a homeowner or listing agent to photograph a residential property for sale. Use it before a shoot that includes standard interiors, aerial drone footage, Matterport 3D tours, or twilight sessions. It is especially useful when the booking involves a retainer, a defined delivery window, or add-on services that need to be itemized in writing before the shoot date.

What's included in this template?

  • Party identification fields for photographer and homeowner or listing agent
  • Property address and shoot date with add-on services checklist (drone, 3D tour, twilight)
  • Total service fee, non-refundable retainer amount, and accepted payment methods
  • Late-fee clause with 1.5% monthly rate on overdue invoices
  • Limited non-exclusive license for MLS, agent marketing, and social use tied to the listing
  • Copyright retention clause and prohibited-use restrictions for stock and third-party transfers
  • Deliverables section specifying platform, minimum image count, and revision rounds
  • Cancellation and rescheduling policy with notice-period and retainer-forfeiture terms

What this form covers

1. Acceptance and Scope

This Agreement is entered into between your photography business and your client — a homeowner or listing agent — for residential real estate photography services at a specific property. It clearly identifies both parties, the property address, the shoot date, and any add-on services selected (such as aerial drone photography, a Matterport 3D tour, or twilight shots).

---

2. Fees and Payment

The agreement sets out a total service fee, a non-refundable retainer due at booking, and accepted payment methods. It also defines the payment window after delivery and what happens if invoices go overdue — a modest 1.5% monthly late fee kicks in automatically.

  • **Total fee** and **retainer amount** are both captured as fill-in fields - **Accepted payment methods** (Venmo, Zelle, credit card, check, etc.) are specified upfront - Travel beyond your defined radius is excluded from the base fee

---

4. Licensing and Permitted Use

One of the most important sections for any real estate photographer. The template grants the client a **limited, non-exclusive license** for:

  • MLS listing use - Digital and print agent/brokerage marketing - Client's personal portfolio or social posts tied to the listing

All other uses — stock licensing, third-party transfers, unrelated advertising — require a separate written agreement. **Photographer retains full copyright at all times.**

---

5. Deliverables and Timeline

Final edited images are delivered via your chosen platform (Dropbox, Pixieset, Google Drive, etc.) within a set number of business days. The gallery includes a minimum image count of your choosing, plus a defined number of complimentary minor revision rounds. Raw files are explicitly excluded.

---

6. Cancellation and Rescheduling

Clients must provide a set number of hours' advance notice to reschedule without penalty. Late cancellations forfeit the retainer. Photographer-side cancellations due to emergencies or weather trigger a full refund or complimentary reschedule — no hassle, no ambiguity.
